KIDDIEWOW TERMS OF WEBSITE USE

The information contained herewith provides the terms of use of our website whether as a registered user or guest.

We implore you to read these terms diligently before you proceed to engage with us.

By using our site, you indicate that you accept these terms of use and that you agree to abide by them.

Your information will be stored and used in an appropriate manner in accordance with the Data Protection Act 1998.

 

ORDER ACKNOWLEDGEMENT

The contract in respect of the products supplied by us to you comes into force when your order has been accepted by us. To enable us to process your order, we will require you to provide us with your e-mail address. We will notify you by e-mail as soon as possible to confirm receipt of your order and to confirm details. For the avoidance of doubt, this correspondence does not constitute a contract between us receipt of an order via our Site does not constitute acceptance of an order.

 

AVAILABILITY

All orders are subject to acceptance and availability. If the goods you have ordered are not available from stock, we will contact you by e-mail or phone (if you have given us details). You will have the option either to wait until the item is available from stock or to cancel your order.

 

PRICE

The prices payable for goods that you order are as set out on our website. All prices are inclusive of VAT at the current rates and are correct at the time of entering information.

  

PAYMENT TERMS

We will take payment upon receipt of your order from your credit or debit card. We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the goods from you, then we can refuse to process your order and/or suspend any further deliveries to you. This does not affect any other rights we may have.

 

DELIVERY

Our delivery charges are set out on our website.

Kiddiewow will always strive to meet your delivery requirements; that’s why we use a wide range of respected courier services that can deliver to most locations without any problems.

All delivery times are stated in working days and do note that in the case of delivery a working day is classed as any day other than weekends or public holidays.

Any purchase made upon a non-working day will only be processed upon the next available working day.

 

Delivery address

Items are sent to the stated delivery address provided by the customer on the online order form, should the delivery address differ from the invoice address, the Customer is to provide both addresses when placing the order online. The parcel will be shipped to the delivery address specifically indicated on the form.

 

Failed Delivery Attempts

In the event of a failed delivery, depending on the circumstances and the courier's policy, the Customer may receive a note of passage i.e., "calling card" in his/her mailbox. If indeed the courier has left a note, the Customer will need to call the courier in order to arrange a new delivery date, if the Customer does not contact the courier service the item will be returned to Kiddiewow office where a redelivery fee will be applicable.

 

Late Delivery

At times a parcel may not be delivered within the expected time allotment or stated delivery time frame given by the carrier and/or kiddiewow.com and the delay extends too long we would expect the Customer to contact kiddiewow.com in order to open an inquiry to establish the whereabouts of the parcel, i.e. the parcel may be lost/stolen/missing.

Please do note that in the case of delivery a working day is classed as any day other than weekends or public holidays.

 

CANCELLATION RIGHTS

We are happy to provide you with a refund or exchange in line with your rights as a consumer. However, if we feel the goods meet the standard as described then we may be able to provide a refund but will not be liable for the cost of postage. If we do deem a product to be below standard we will happy provide you with an exchange or refund.

    

LIABILITY 

Unless agreed otherwise, if you do not receive goods ordered by you within 7 days of the date on which you ordered them and decide to cancel the order rather than re-arrange delivery (in accordance with clause above), we will provide you with a full refund.

We are only responsible for losses that are a natural, foreseeable consequence of our breach of these terms and conditions.  We do not accept liability if we are prevented or delayed from complying with our obligations set out in these terms and conditions by anything you (or anyone acting with your express or implied authority) does or fails to do, or is due to events which are beyond our reasonable control. 

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site.  The importation or exportation of certain of our goods to you may be prohibited by certain national laws.  We make no representation and accept no liability in respect of the export or import of the goods you purchase. Our customers are therefore advised to check with the local authorities of their country of residence about the entry conditions for the ordered items. It is the customer's responsibility to make the necessary declaration(s) and/or payment(s) to the appropriate authorities and or officials in their respective country.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.   You have certain rights as a consumer including legal rights (e.g. under the Act) relating to faulty and/or misdescribed goods.

 

NOTICES

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address and all notices from us to you will be displayed on our website from time to time.

 

CHANGES TO LEGAL NOTICES

We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.

 

LAW, JURISDICTION and LANGUAGE

This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

 

INVALIDITY

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

 

PRIVACY

You acknowledge and agree to be bound by the terms of our privacy policy.

 

THIRD PARTY RIGHTS

Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
